Default stupid quick lube shops... who pays, me or the shop?

ok so i bought this 95 mustang a few months ago, 5 speed, wasnt sure how the tranny fluid was so i had it changed at my local quick lube shop (unsure of name but i know location) they changed it and i went on my way, it drives fine and even shifts better than before, but after a few days i noticed a burning smell, i put my car on my lift and saw on the tranny drain plug that the aluminum case had been cracked ( from over tightening the plug of course) i was standing in the shop while the mechanic tightened down on that plug with a 3/8 ratchet,he never once torqued it to spec, just cranked down, but it did not click in my head to check the plug for cracks, now that is cracked what can i do? should the shop pay or me? i know for a fact that it was not cracked before the fluid change, because the shop had to inspect it before they would even touch it, they told me that many people try to scam them by bringing them a faulty tranny and blaming them, but they screwed this one up

good luck trying to get them to say its there fault not worth all the trouble. even tho there at fault its a pita just buy the new plug do it yourself and never go there again.

It's a waste of breath to try to get them to cover it...all they'll say is it was fine when it left the shop....just go buy some JB weld and hope that'll do the trick
